These Terms of Service ("Terms") govern your access to and use of the Supple mobile application and related services (the "Services"), operated by Heather Hill, doing business as Supple ("Supple," "we," "us," or "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Supple is a cosmetic skin-wellness application. It uses a photo of your face to estimate cosmetic skin metrics and to provide general wellness suggestions and provider recommendations.
Supple is provided for cosmetic and informational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Its scores, "skin age," and recommendations are cosmetic estimates and must not be relied upon as a substitute for professional medical or dermatological advice. Always consult a qualified healthcare provider with questions about a medical condition.
You must be at least 18 years old to use the Services. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
You retain ownership of the photos and information you submit. You grant Supple a limited license to process that content solely to operate and provide the Services to you, as described in our Privacy Policy. We capture and use facial images only with your consent and only to provide the cosmetic analysis. We do not sell your facial data or use it for advertising. You may delete your account and associated data at any time from within the app.
Some features may require a paid subscription ("Supple Pro"). Subscriptions are sold through Apple and billed to your Apple Account. Payment, renewal, and cancellation are handled by Apple in accordance with the App Store terms; manage or cancel auto-renewal in your Apple Account settings. Except where required by law or Apple's policies, fees are non-refundable.
You agree not to misuse the Services, including by: uploading images of anyone other than yourself without their consent; attempting to reverse engineer, disrupt, or gain unauthorized access to the Services; or using the Services in violation of any applicable law.
The Services, including all software, design, and content provided by us, are owned by Supple and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial use.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or accurate.
To the maximum extent permitted by law, Supple will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months preceding the claim.
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Services or other users.
We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles.
